我國為保障人民學習及受教育之權利,於1999年公布《教育基本法》,且為能落實教育基本法鼓勵政府及民間辦理教育實驗之精神,於2014年11月分別頒布了《高級中等以下教育階段非學校型態實驗教育實施條例》、《學校型態實驗教育實施條例》以及《公立國民小學及國民中學委託私人辦理條例》。鑑於「實驗教育三法」的頒布將對我國中小學教育的發展與創新有所影響,本文旨在析論實驗教育三法通過後我國中小學教育之發展,首先概述實驗教育三法的立法精神並加以評析,其次分析實驗教育三法對我國中小學教育的影響,再者則論述因應實驗教育三法促進中小學教育發展應有之前瞻作為。

英文摘要

To protect our people learn and the right to education, the Fundamental Law of Education had been released in 1999. Further, for the implementation of the Fundamental Law of Education can encourage government and civil handle education experiment, the government in November 2014, respectively, issued the implementing regulations for non-school education in the level of upper secondary education or less, school experimental education implementing regulations, and private management of public school for public elementary schools and junior high schools. With the promulgation of three regulations, it will have impacts on primary and secondary education in Taiwan. This article focused on the analysis of the development of primary and secondary education in Taiwan. Firstly, the spirit of three education legislations and comments were analyzed. Secondary, the impacts of experimental education in primary and secondary education of Taiwan were explored. Finally, the proactive approach in response to the development of primary and secondary school education were proposed.
