本文之研究目的在於從法律之觀點，探討美國各級法院關於父母在教家育權相關判例之演進及問題爭議所在，並探討美國現行在家自行教育法制，從而分析各法律案件之本質對我國教育之啟示，進而提出建議，做為我國規劃在家自行教育法制之參考。
英文摘要
The purpose of this article is to analyze the related juridical cases about home schooling in the United States of America and research current educational system of home schooling in the United States of America, in orderto identify the characters of the educational system of home schooling in the United States of America. Finally, the author proposed some suggestions for the education in the Republic of China.
