本文透過明代判牘《㽦辭》所收錄的婦女非殉節型自殺案件,討論 原本應該屬於家務事的自殺行為形成訴訟的原因,並且以律條的定 義與案件內容的對照,分析州縣官是以「威逼」而非「圖賴」理解 婦女非殉節型自殺案件,並以〈威逼人致死〉律進行審判。三木聰 研究福建地區圖賴現象時,認為審判者面對圖賴案件時,為了將案 件壓在州縣層級,因此採用〈威逼人致死〉律,而非〈殺子孫及奴 婢圖賴人〉律。本文的理解便可用以重新檢視三木聰對於圖賴案件 審判過程的結論。

英文摘要

By using material from the private judicial collected papers “Xunci (㽦辭)” in Ming Dynasty, this article is intended to discuss why some family affairs of which women commit suicide except to defend her virtue could change into criminal cases. I will compare those cases with legal regulations, and try to indicate that, in the judgment, the governor would rather adopted the concept of coercion (wei bi 威逼) than tu lai (圖賴). Researching the phenomenon of tu lai in Fujian area, Satoshi Miki presumes that the governor would not adopt the clause “sha zi sun ji nu bi tu lai ren lü” (〈殺子孫及奴婢圖賴人〉律) but to take the clause “wei bi ren zhi si lü” (〈威逼人致死〉律) in order to make the criminal cases stayed in the county. As stated above, this article can be used to check Satoshi Miki’s conclusion of the judgment process in tu lai.
