中文摘要

中華民國政府於2003 年提議修法變革大學校園治理組織和校長遴選方式,本文採政策論證方法研究修法可能產生的結果,發現趨於行政權集權而愈形強勢。從論證發現二點:第一,教育部修法的假定不一定正確。修法後校長遴選過程由過去的兩個階段變成一個階段,由教育部成立遴選組織,並掌控二分之一以上遴選委員負責幫大學挑選最適校長。這種將民主遴選修改為監護式遴選,將可解決校園派系紛爭和校內產生的校長無法吸引校外菁英人才來校服務的問題,不一定會成立。筆者認為應從遴選過程加強規範做起,並強化教授自律觀念,當可獲得改善。此修法目的,恐怕是找錯問題作答案。第二,大學將喪失自主自律觀念,降低自立解決問題的能力。監護式選出的校長,向遴選組織的權力來源機關負責,不是向大學內部各級各類團體成員負責。校內決策過程減少了溝通取得共識的程序,決策似較有效率,但大學解決教育問題的職責就慢慢變成是行政官僚系統和其上級的責任,全校各成員也漸處於決策邊緣。如此,過去大學內部因為相互間互賴、溝通、和聯合行動所形成的自己解決問題的能力,將逐漸喪失。

英文摘要

Analyzing the coming amendment of the University Law in 2003 in Taiwan, we found that the change of the Chief leader selection in higher education institution do have effects on the power relationship within the organization. It will make the features of the universities more centralized and guardian-like in the future. The executive power will get stronger than the council and senate. The author asserts that the problems that the government wants to solve are wrong ones, which could be solved by other ways. Instead, by amending the law in the current direction, the universities’ capabilities of solving problems will be destroyed and disappeared in the long run. The democratic spirit and participative opportunities should be provided in the process of leader selection process in order to create an organizational culture fit for cooperation and interdependence, which, in turn, will contribute to the universities’ capability to compete.
