中文摘要

我國教育的根本大法--「教育基本法」在八十八年六月二十三日,由總統公布施行後,受到社會各界相關人士的普遍關注,因為該法案攸關我國未來教育工作的發展,對於各項教育革新更具有深遠的意義,因此,唯有瞭解該法之主要內涵,始能有效掌握國家未來教育之脈動,並作必要之因應。本文主要分成四個部分,首先說明「教育基本法」之立法過程;其次則分析「教育基本法」之主要內涵;再其次,則就「建構教育法令體系值得肯定、教育經費之保障問題應重視、教育作為之中立原則應落實、私人興學動機與成效待評估、教師專業自主與自律須兼顧、家長參與教育之功能須探討、教育審議委員會定位待深究、教育實驗研究與評鑑待規劃」等八個方面申述該法對教育革新之啟示;最後,則懇切提出強化執行層面、促進教育革新之呼籲,期能有效發揮「教育基本法」應有之功能。

英文摘要

The Educational Fundamental Law was published by the president on June 23, 1999, which also attracted the public's attention. It is very important to probe the meanings of the Educational Fundamental Law in order to deal with the educational development in Taiwan. The purpose of this paper is to explore the implications of the Educational Fundamental Law on educational innovation. There are four parts in this paper. Firstly, the process of legislation is explained. Then, the meanings of the Educational Fundamental Law are analyzed. Thirdly, the implications of the Educational Fundamental Law on educational innovation are proposed. Finally, to strengthen the process of implementing the law is emphasized.
