中文摘要

本文以內容分析法,對各縣市所制定的「國民教育階段非學校型態實驗教育實施辦法」進行分析,以了解我國實施在家自行教育的現況,並以家長教育選擇權、學生學習權等法制概念,來檢視有關在家自行教育的相關法律內涵,期盼能夠提供改進我國在家自行教育實施的參考。本研究有如下發現:
1. 部分縣市規定實施非學校型態的實驗教育不得聘請現任公立學校專任教師兼課,此項規定限制了從事非學校型態實驗教育者的教學資格,不甚合理。
2. 在學生學習評量部分,有縣市規定學生必須於計劃結束前或畢業前,參加被依附學籍之學校評量,通過後方可領畢業證書,評量制度缺乏彈性。
3. 部分縣市所成立的在家自行教育審議委員會,其成員不夠多元,未能充分保障家長的權益。
4. 仍有部分縣市未訂定在家自行教育之實施辦法,影響學生的學習權。
5. 多數縣市在申請實施在家自行教育時,子女本身的意願性並未在考慮在內。
6. 在家自行教育的輔導及評鑑實施要點不夠明確,學生家長無所適從。
7. 有一些縣市甚至要求,申請在家自行教育者應檢附父母或實施單位的所得證明,不符合公平正義原則。
依據研究發現,本研究提出了相關的建議。

英文摘要

The voice of parental education choice is louder and louder accompanying the open education reform. Home schooling is an educational alternative that parents can choose from. The ideal of home schooling is to ensure the rights of students’ learning and parental education choice. In Taiwan, the laws and regulations of home schooling have been enacted. However, the extent of the fitness with theories as well as the implementation feasibility, are not systematically reviewed.
The purpose of this research is to understand the status quo of home schooling by analyzing related laws and regulations. The spirits and merits of home schooling are introduced in the article. Laws and regulations of home schooling enacted in local government, are examined through the concepts of the rights of parental choice and students’ learning. Conclusions are drawn and suggestions are provided based on the results of the content analysis of present laws and regulations. The research hopes that the implementation of home schooling will go well.
