各先進國家對家長參與皆十分重視，但家長參與的範圍與影響究竟應有多廣，實有界定與評估的必要。因此本文從教育基本權的面向切入，並分成家長參與學校事務的內涵、家長參與的法規範內容差異、教育基本權作為家長參與學校事務的憲法依據，以及在我國的具體實踐與檢討等四部分作為說明，以瞭解家長參與學校事務時所可能產生的法律問題與爭議。
最後，根據相關文獻探討，發現家長參與學校事務時較容易有爭議之處共可分成:家長個別與集體參與權、專業自主權與家長參與權，以及資訊權使用等三大部分，並進一步提出下列建議以作為修正之參考。
一、在整體概念上，家長參與學校事務之概念範疇盡速釐清。
二、在基本權的落實方面，家參辦法的制訂確實對家長教育權有更深一層的補充意涵，但光是透過行政命令的制定顯不足，因此需要及早透過法律位階的家長參與學校事務法來加以實踐。
三、在影響方面，有助於落實家長參與之實踐，改善既有家長參與缺乏實質影響、缺乏正確資訊等缺失，但對於新衍生出的參與衝突問題，必須再一次細部檢討實務上之運作與解決之道。
四、在法令修訂方面，建議能增列家長參與教育的列舉事項或相關範圍，並增列發生爭議的相關處理方式與程序，以便進一步保障相關利害人應有之權利。

This study focuses on discussing rules of parent's involvement in campus. After studying some papers about the theme in the past; we found that those rules about restrictions on parent's involvement in campus could go against the fundamental human rights and laws. Themajor contributions of this study are to identify the range of parent's involvement in campus， to discovering the problems about parent's participating in fact. Finally，these are found to include (1) it is necessary for the related authorities to identify the range of parent's involvement and to clarify the responsibility of different groups (2) some of the regulations which violate the principle of proportion should be modified in order to ensure the basic rights.
