中文摘要

尋租行為的不透明性以及差異的多樣性,使得分析尋租行為時,相對地較為困難,以致於探討尋租行為與土地使用分區管制的研究亦較為缺乏。本研究嘗試以財產權的觀點,透過新制度經濟學(NIE)的財產權分析方法,輔以集體行動的個案,分析現行土地使用分區管制制度下,尋租行為的型態與生產路徑,如何與土地使用分區管制產生因果循環的關聯,繼而造成制度變遷。研究的成果,將反饋到分區管制制度設計的議題上,並提出避免因為尋租行為而產生負面問題的具體建議。本研究的成果,包括對土地使用分區管制變更的動力來源、過程以及政府面對尋租行為的反應等分析見解,值得都市規劃領域研究的參考。

英文摘要

It is difficult to analyze rent-seeking behavior due to its opaqueness and variety. This leads to little studies on the relationship between rent-seeking behavior and zoning. Based on the property rights approach of New Institutional Economics, this paper investigates the rent-seeking behaviors and production paths under the current zoning institution. In addition, it explores the impact of rent-seeking behaviors and the production paths resulting in the change of zoning institution. Studies of collective action are employed to address the above issues. The research suggests solutions to issues related to the institutional design of zoning and methods to avoid negative effects of rent-seeking behavior. Moreover, the paper provides sources and processes of institutional change of zoning and ways government responds to the rent-seeking behaviors for further study.
