行政協力是符合行政民主化、法治化的制度性選擇，已成為當今舉世諸國行政實踐過程中極為重要的行政手段和行為形式，於國家重要工程建設環節，由國家與相應的企業共同合資合營的計畫，涉及計畫性因素、法規因素、企業誘因以及行政權的特許等複雜因子，諸如企業參與的B.O.T 工程為最。為準確界定釐清行政協力的概念，乃是行政協力制度化建設首先要解決的問題。而對於行政協力的內涵、要件、分類也是討論行政協力概念不可缺少的重要環節與要素，就行政協力與行政協
助、行政參與人協助（力）義務、社會協助、行政委託等相類似的概念，其中既有聯繫也有區別，有必要在辨析中加以明確行政協力內涵和外延。故正確解讀行政協力的法律性質問題，對於把握行政協力的本質至關重要。

Administrative Cooperation, as a system which is fit for the tendency
of administration democracy and nomocracy, has been an important administrative means and legal action form. Identifying the concept of
