中文摘要

教師申訴制度乃當教師的合法權益受到侵犯並造成損害時,獲得恢復和補救的一個有效的法律途徑。我國在1995年公布實施《教師法》後,奠定教師申訴制度的法源基礎,也確立了這項維護教師合法權益的行政救濟程序。本文旨在透過「教師申訴制度」的歷史沿革及其性質、「教師申訴制度」與《行政程序法》關係之探討、提起申訴(再申訴)的相關規定及實務上的作法、評議程序的過程及評議決定的效力等方面來檢視教師申訴制度的實施概況,最後以台灣省教師申訴評議委員會之申訴評議案件分析來闡明申訴制度之重要性。本研究發現:一、相較於《訴願法》所建立的訴願制度,教師申訴制度確實仍有許多不完善之處,須加以改善;二、教師申訴制度推行至今已13年,經由台灣省教師申訴評議委員會之申訴評議案件計有338件,受理的申訴類別亦頗具多樣性,主要包括考績、懲處、敘薪、聘任等案件。

英文摘要

Teacher Appeals System allows teachers to seek legal redress for any official decisions that infringe on their rights. Teachers’ Act, which was enacted and implemented in 1995, lays the foundation for Teacher Appeals System and insures the administrative redress procedures to safeguard teachers’ legal rights. The aim of this study is to examine the execution of Teacher Appeals System through discussing the evolution and the nature of the system, exploring the relationship between the system and Administrative Procedure Act, analyzing the related regulations and practice of filing appeals, and examining the procedures of review and the efficiency of review decision. The study expounds the importance of Teacher Appeals System via analyzing the grievance cases provided by the Teacher Appeal and Review Committee of Taiwan. According to the documents analysis, two conclusions can be drawn: First, compared with Appeals System under Appeals Act, Teacher Appeals System has much room for improvement. Second, it has been 13 years since Teacher Appeals System was implemented. Since then, 338 appeals have been filed, according to the Teacher Appeals and Review Committee of Taiwan. The categories of the appeal cases are various; they are related to appraisal, punishment, salary, and recruitment to name but a few.
