電影著作權為智慧財產權之一種，各國均以法律保障其利益，以激發電影界與電影從事人員之投資與創作意願，以此促進國家文化發展、提升人類精神生活。現我國著作權法已將電影列入著作權保護之範圍，惟國內少數人不知尊重他人之智慧財產權，業者亦缺乏對電影著作權之認識，致盜錄租售事件層出不窮，影響國家形象。本文擬探討電影字幕之翻譯是否亦在著作權法保護之範圍，並思索「電影字幕翻譯權」之名稱，是否妥適？

The movies copyright is one kind of intellectual property, it is protected by law in many countries, with the purpose of stimulating the willing of investment and creative work of the movies industry and the people who work on this field, the copyright law in Taiwan has included the movies into the protection area of copyright, but many people still do not respect the intellectuarticle studies whether the translation of movies subtitles would be within the protection of the copyright, as well as thinking if the nomination of “translation right” would be suitable.
