美國氏事訴訟制度與我國民事訴訟制度無論基本原理與實際運用皆有許多差異，但非常複雜，且饒有特色，，更有不少值得我國反省或借鏡之處。惜國人有關英美法之研究文獻雖多，但此方面之論著似尚付之缺如，是將多年來研究此方面之筆記加以整理補充，勉力撰成此文，除指陳美國氏事訴訟制度之特色及實際運作外，並不時與我國相關規定或制度加以比較，使讀者對彼邦民事訴訟之靜態與動態有清晰之了解，並希望喚起國人對英美民事訴訟制度之重視與興趣，將其優點在立法與司法上加以參採'以期對正義之實現有所助益。
英文摘要
The American Civil procedure system is very complicated and far different from our law. Yet it has a lot of features and strong points meritting our attention and even adoption. In view of the fact that in this country so far no article of over-all analysis of American Civil procedure has been written， the author made great efforts to fill this void and write this article by pointing out the features and many facets of American Civil procedure and made comparison with our own system whenever feasible so as to give the readers a vivid picture about how they really works.
