中文摘要

部分工時勞工與全時勞工間之差別待遇所引起之法律問題雖然不在少數,但我國現行勞動法制卻少有規範。國內雖已有相當數量關於部分工時勞工保護之先行研究,但多數文獻係為個別爭議點之研究,少見有提出具體、完整之立法建議者。就此,本文仍以部分工時勞工之立法保護為題進
行研究,希冀能得到若干具體而可行之成果。為達成此一目的,本文仍先就實務上我國部分工時勞工易遭遇之不當待遇,主要包括加班費、例假日及特別休假、勞健保、教育訓練等問題進行探討,並說明以法律解釋方式來處理此些問題之界限。經由深入探討說明此些問題之多數必須依靠立法保護始能解決,並參考日本及韓國有關部分工時勞工保護立法之體例及重要內容後,再提出本文有關部分工時勞工保護之立法建議。本文提出以下之具體的建議,包括應以專門立法之模式俾利民眾遵循,以及應納入規範之內容,除禁止雇主因勞工係為部分工時之僱用形態而為差別待遇此一基本原則外,至少應有勞動條件之書面告知、參加社會保險、教育訓練及例假日與特別休假等事項。

英文摘要

Although lots of difficult problems have arisen out of different treatments for part-time workers and full-time workers, there are still few words in Taiwan labor law regulating such problems. There have actually been some papers published in Taiwan undertaking research for protection of part-time workers,nevertheless, these papers are only focusing on some specific disputes and few concrete and systematic proposals have been submitted in this field. As such,this paper is to initiate a study on possible legal protection for part-time workers
in Taiwan. For this purpose, it is to look into the possible unfair treatments parttime workers may receive in Taiwan from time to time, including overtime payments, regular holidays and paid leave, labor insurance and health insurance,education and training, and further to explain the limits of solving these difficult problems only through legal interpretations. Consequently, it is to confirm that these problems can be settled only through formal legislation, and with reference to the Japanese and Korean labor law regulating part-time workers, it is to propose some legislative acts for protecting part-time workers in Taiwan. It is submitted in this paper that there must be some statutes to be enacted in Taiwan so that they can be observed by the general public, and the contents to be adopted in these statutes shall at least include, in addition to the fundamental principle for prohibiting employers from providing different treatments to parttime workers, giving a written notice containing working conditions, providing social insurance, education and training, regular holidays and paid leave, etc.
