中文摘要

我國不動產不實廣告導致之交易糾紛屢見不鮮,交易安全素為人所詬病。究竟應如何管理不動產廣告?或許可藉由外國法制之探討,找出一些方向。在不動產廣告管理上,德國有相當多規範,如民法典、競爭法、住房中介機構法、價格監管法等,以維護消費者權益。為轉換歐洲共同體所訂頒之指令,德國不正當競爭防制法業已於2008 年修訂,擴大了消費者保護範圍。在不動產廣告不正當競爭表現型態之防制機制上,包括對於商業誤導、顯而易見廣告、運用高風險用語、傳達高收益訊息、經紀虛假宣傳、依其他法規應予以明示、對於物件性質資訊揭露、關於專業頭銜使用以及專家宣稱等方面。此對於現行不動產廣告相關規制方式有值得參考之處,並可提供研擬與修訂方向。

英文摘要

The disputes of real estate transactions are frequent in Taiwan; the transaction has been criticized for safety. How should we guarantee the security of real estate transactions? Germany has many management laws in real estate advertising, such as the Civil Code, competition law, the housing agency law, price control law. Those laws could protect the interests of consumers. In addition, for the conversion of the European Community directive, the German Unfair Competition Prevention Law was
amended in 2008; it could expand the scope of consumer protection. The Real estate advertising in violation of unfair competition law cases are: for the business of misleading, obvious ad, the use of high-risk term, message to convey high-yield, broker false declaration, other laws and regulations shall specify, reveal the nature of the object, the use of professional titles, experts claim. The real estate market in Germany is reputable for its steady and dependable system; and the norms of civil law, land registration, presale housing model, and unfair competition are similar to a certain extent, and the management of real estate should be
worth as a reference.
