英美刑法自成一個體系，與大陸法系之結構、法理、原則、觀念有不少差異，富有不少特色，可供我國借鏡之處甚多，但國內通盤探討美國刑法之理論及運用之專著極為欠缺。本文爰自理論與實務之立場，試將美國刑法之基本原則、特色與實際運用，儘量深入淺出，作扼要通盤之探討，俾供關心人士了解之一助。
英文摘要
American criminal law is very complicated and yet very interesting and
stimulating because it has various components and a lot of special features which merit our attention. It is a pitty that so far no overall article about such law has been written in this country.The author endeavors to explore its development, basic princinciples and rules, special features and other important facets. This article will also explain various kinds of crimes under American law and indicates how they really work and how they manage to meet social change. Whereever feasible he will also made a brief account of the difference between their law and our own law. Mention will be made about certain special concepts of American criminal law, such as conspiracy,defenses, misprision, compounding crimes, etc.
