臺灣現行的民法物權編於1929年制定於中國大陸，在2007年、2009年、2010 年才通過通盤性的修正，原物權法條文在修正前適用已超過60 年，在修正通過前，法典雖然並未修正，隨著許多特別法的制定，以及學說和判決的引導下，物權法已隨著社會經濟的變化而發展，許多已脫離法典的原貌，也脫離許多教科書的傳統見解。2007年、2009年、2010年修正的幅度非常大，修正後的新條文，雖然有待解釋和適用，但從許多基本原則的變更可知，新物權法將朝向一個自由的方向而發展。本文依序探討早期的臺灣物權法制、修法前變遷中的臺灣物權法制、修法後的臺灣物權法制以及臺灣物權法制發展的前瞻，全面性地說明臺灣物權法制的變遷與前瞻，希望有助於對於臺灣現行物權法的理解和解釋適用。

The current R. O. C. Civil Code-Property was enacted in Mainland China in 1929. These articles had not been amended until 2007, 2009, 2010.Original articles were in force in Taiwan more than sixty years. Before amendment, following the enactment of many specific statutes, the guidance of scholars' opinions and judicial decisions, the Taiwanese property law had progressed following the social and economic change, and the real meanings
of the code had been changed substantially and was deviated from the
interpretation of old textbooks. The amendment of the Code in 2007, 2009,
2010 is comprehensive, though still necessary for interpretation. From the
alteration of the basic principles, it is known that the new Taiwanese property law is approaching to a more liberal direction.This thesis, a comprehensive exploration of the transition and prospects of the Taiwanese property law, in sequence, explores the early Taiwanese
property law, the transition before the amendment, after the amendment, and prospects of the Taiwanese property law, and hopes it will be useful for the understanding and interpretation of the current Taiwanese property law.
