本文旨在探討現行通訊監察法制於國安情報監察之適用及衍生之疑義，為能有效杜絕非法監聽，完善通訊監察法制，並滿足國家安全維護之需求，本文主張應制定以國安情報通訊監察為主要目的之專法，用以規範以國家安全維護而非以犯罪偵防為目的之通訊監察，以避免情報工作人員因法制不健全而罹刑章。又為免通訊監察法制間出現積極衝突，本文亦主張應修正現行通訊保障及監察法，使之成為以犯罪偵查為目的之通訊監察專法。

This study discusses problems resulting from current intelligence practice
under the Communication Protection and Monitoring Law. To avoid any illegal practice, this study suggests passing a law focused on intelligence collection under the National Security purpose in addition to the Communication Protection and Monitoring Law, with which intelligence agent could comply. Furthermore,this study also suggests amending the Communication Protection and Monitoring Law so that conflicts between these two systems would not become a new problem.
