修正後刑法第10條第4項對於「重傷」的定義，於第1款至第5款的列舉定義，除原先的「毀敗」外，增列「嚴重減損」亦屬重傷的規定。惟「嚴重減損」在解釋上，除「嚴重性」的標準應如何解釋存有疑義外，所謂「減損」也必須證明「傷害後」的機能低於「傷害前」的機能，始足當之，如何認定，不論在實體標準或證明程序上，均存有重大疑義。故本文擬由醫療實務上對於視
覺機能、眼的功能的判斷，以及視能的醫療鑑定實務，對刑法修正後「視能與重傷」的關係提出討論，本文初步認為刑法上所評價的視能，其核心內涵應為視力及視野。

The serious injury in Revised Criminal Law Article 10, paragraph 4 is
defined as not only destruction but also serious impairment. The interpretation ofs erious impairment includes the severity and impairment. With regard to impairment, we have to prove that the function after injury is lower than that function before injury. However, it is very difficult to prove that in Criminal Law. Therefore, the purpose of this article is to discuss the relationship between visual function and serious injury by means of their concepts and their application off unction identification in medical practice.In summary, visual acuity and visual field are the core concepts of visual function and serious injury.
