面對新的國、內外環境，各國政府均重新思考如何以靈活的部隊編裝、統合的三軍聯合戰力及優勢的指管通情系統等，建立符合未來戰爭與執行非傳統安全任務的國防武力。國防二法為國防領導指揮體制轉型的重要分水嶺，將包括國防組織調整、文人領軍、軍隊國家化、軍政軍令一元化、建立聯合作戰指揮機制、獨立軍備體系、國防自主及全民國防等未來國防發展方向載明其中，代表我國國防發展符合現代民主精神。不過，無可否認地，在推動以國防二法為核心的軍事事務革命過程中，也發現不少當初因缺乏周延的配套措施所衍生的問題，這些有結構性的問題，包括憲政型態、政府形式、組織結構及運作方式的問題。本文希望從以上四個面向分析探討，提供國防領導指揮體制轉型的解決方法，有效提升國防戰力。

In the face of the new internal and external environment, the governments of various countries have rebuilt considerate system of armed forces to carry out the war and non-traditional security task.National Defense Law and the Amendments to the Ministry of Defense Organic Law were the important watershed where the national defense system transformation, including national defense organization change, the civilian control, nationalization of armed forces, streamlined military administration and command, setting up combined operation command mechanism, independent arms system, and all-out defense. It represents development of national defense of our country with modern democratic spirit.But, undoubtedly, National Defense Law and the Amendments to the Ministry of Defense Organic have some questions, including constitution, government, organization, and the framework and operation. This text hopes to discuss from above questions, to offer the solution of national defense system transformation, and to improve the capability of ROC armed forces.
