受試者權益保護的重視始於醫學研究。與醫學研究相似,教育研究經常以人當實驗對象,但在教育研究中受試者權益保護方面卻甚少探討。受試者權益保護是對受試者個體身心自主權之尊重與保障,因此不僅是研究者需寄予關注之工作,亦應是學術期刊之審核要求。本文首先提出三個教育研究中受試者權益遭到傷害之案例,之後從受試者權益保護的發展沿革、對受試者權益保護之相關法規,以及美國教育研究協會之「倫理準則」中對「研究族群、教育機制及社會公眾」的觀點,探討「告知的同意」、「隱私與保密」、「信任關係」在受試者權益保護上的倫理議題與相應機制。文章最後藉由先前三個案例提出討論與四項建議,以推動台灣教育研究者對受試者權益保護之重視,並供國內教育學者與教師作為未來研究與教學的參考。

英文摘要

The protection of experimental human subjects begins with medical research. Education research is similar to medical one in that both employ human subjects for experiment. However, the protection of the rights and interests of the subject is rarely mentioned. Such protection is a guardian of the integrity and respect of the subjects. Hence it is not only required in research, but also requested by academic journals for publication. In this paper, we start with three paradigmatic cases in which the rights and benefits of the subjects may be infringed. It then traces the development of the protection of the subjects by law and the perspective of the relationship of research groups, educational institutes and the publics in the ethical standard of American Education Research Association. It gives a detailed analysis on the ethical problems and mechanism of informed consent, privacy and confidentiality, and trust in such educational research. We end with an analysis of the three cases and propose four suggestions for the researchers as well as for educators in the promotion of human subject protection in Taiwan educational research.
