本文的出發點主要為探討規範邏輯對基本權利之形式表現有何貢獻。而本文在系譜學的研究上，亦以找出Hohfeld權力概念的法律關係之理論與Alexy基本權理論之關聯性，並由規範邏輯的觀點發現Hohfeld的規範邏輯之構作及推理，可以與Alexy基本權規範邏輯之表現進行比較。Hohfeld在其1913/17年「法律思維中應用的基本法律概念」一文中嘗試以八個概念如權力、義務、無權利、特權、權力、責任、無權力、豁免來構作法律關係，同時又推出這八個概念間有相互關係者有形成四組兩兩「倒轉(correlatives)」的關係(權力─責任、權力─義務、特權─無權利、豁免─無權力)；以及四組兩兩「相反(oppositive)」的關係(權利─無權利、權力─無權力、特權─義務、責任─豁免)。雖然，Hohfeld當時並未呈現權力概念之間可能組成四角方塊之概念間的規範邏輯之表現。甚至於Hohfeld的研究，今天觀之，可能覺得其權利概念之法律關係的體系尚非常非常緊密，然其1913與1917所發表的論文，在當時具有相當新穎性，甚至不容易為當時學界所理解，經過長久時間的發酵與影響，促使今日法學研究權利概念之間的基本法律關係之學者，不能忽視Hohfeld的研究成果。
Alexy在其教授資格論文《基本權利理論》一書中，亦用規範邏輯來表現Hohfeld的權利概念間之法律關係，並形成四角方塊。惟Alexy的重點乃在基本權力體系之構作。因此，規範邏輯在Alexy的作品中是當作基本權利體系構作的工具。Alexy主要的工作乃在體系化基本權利，建構出一完整的基本權利底理論。也因為要建構完整的基本權利理論，因此，Alexy亦必須上溯到德國著名的公法學者Jellinek之譏本權利身分地位理論的討論。Alexy依此發展出涵蓋(1)對客體之主觀權利，(2)自由，(3)權限在內的「法律的基本地位的體系(System der rechtlichen Grundpositionen)」。
Alexy的作品堪稱是規範邏輯對基本權利理論購做運用的一成功例子，亦是基礎法學研究對基本權釋義學能有所貢獻之例子。

In his seminal work, “Some Fundamental Legal Conceptions As
Applied in Judicial Reasoning” (1913, 1917), Hohfeld attempted to
constitute legal relations with eight concepts which he grouped into four
pairs of Jural Correlatives (Right─Duty, Privilege─No-Right, Power─
Liability, Immunity─Disability) and four pairs of Jural Opposites (Right─
No-Right, Privilege─Duty, Power─Disability, Immunity─Liability).
Although two pairs of Jural Correlatives and Jural Opposites are
included in Hohfeld’s conceptual framework based on eight concepts of
rights, they did not constitute two Quarterdiagrams. In contrast, Alexy
attempted to re-constitute Hohfeld's four concepts (right, duty, no-right,
privilege) into a Quarterdiagram, in which Jural Correlatives and Jural
Opposites are included.
In a similar vein, Alexy drew on Jellinek's theory of status in
constitutional law to develop his System der rechtlichen Grundpositionen,
in which rights to (1) service, (2) freedom and (3) power are included.
