軍費生公費償還事件在近幾年來於各級行政法院受理件數增加，主要在於監察院審計部發現國軍對於軍事院校轉學、退學及開除學籍的學生賠款，竟有高達十億多元的金額尚未追繳，甚至有許多追繳案件都因為年代久遠而「查無此人」。因此，審計部發文給國防部，要求清查各軍校歷年退學賠款未清償的狀況，至於應如何追償軍費生違反義務之賠償責任發生時，一直以來都是軍事學校或國軍各機關、部隊的燙手山芋。導因於各軍事院校及各部隊對於軍費生與軍校之法律關係定性解釋差異致使選擇法律途徑錯誤，延誤該公法上請求權時效，致生社會輿論的批評。對此，本文則以案例說明之方式，探討給付訴訟之程序上思維及行政契約違法性之審查步驟。期待本文之提出能對國軍軍事院校追償公費或各部隊所屬官兵溢領薪餉等其他類似案例產生啟發性之功能，並建立一個對行政訴訟案例應有體系的思維模式，使法律的論證更具客觀性與可驗證性。

The aim in this research plan is to research the Liability of the Militarysponsored Students When Disobeying Obligations.The MOD sponsors military education with establishing military schools and recruiting students so that the military manpower would be sufficient in the long run, which is necessary to build the national defense power. Upon execution of the contract (in the form of a letter of volunteer or guaranty) between the school and the Militarysponsored Students,such provisions become part of the contract and both parties thereto should perform the obligations thereunder in good faith. These provisions are necessary in order to achieve an administrative objective When the Military-sponsored Students are dropped out, expelled or early-discharged, which conflicts with the signed administrative contract, how to recover the loss becomes a question. Hence, the only way to recover the loss is to file an administrative suit. Therefore, considering the said concerns, this Essay first examines the tendency of the court decisions in Taiwan and relevant regulations , and then researches the administrative contract.Finally, this Essay make the suggestions regarding to increase administrative efficiency and protect individual rights.
