在學校教育中,「懲罰」是管教與維持紀律的方式之一,伹因懲罰此觀念有其 高度複雜性,讓教師易與艄澦等概念混淆。2006年《教齊基本法》修正後將 體罰」明文入法,雖然值得肯定,但也因教育法令與學校筲教辦法仍未能清楚界定 懲罰與體罰等相關概念,致教師在管教上猶有疑臌。本研究即在朌清「懲33」的定 義及其相關概念,提供中小學教師锊教學生之參考原則。本文縛先閜釋了分析教育 哲學的概念分析法,接荠分析懲罰、體闐等相關概念的意義,以及懲33的目的與原 理,指出懲罰與體邡之問的界線W不易清楚界定,懲:斑應以感化性及恕道性為主。 最後並依此詮釋其對教師管教的三點啟示:(一)懲罰須符合恕道性與教育性原 則;(二)懲沏應符合比例原則;(三)巡用钓怨進行適常的管教,期能#助於教 師在運用管教權時,掌握心中的價值最尺,達到師生雙蠃理想。

英文摘要

To punish students is one way lo maintain the discipline in the school. The concepts of punishment are so complex that teachers confuse it with corporal punishment. Though Educational Fundamental Act in 2006 brought the idea of zero corporal punishment into laws, principles and rules of educational institute and schools hadn't clearly explain definitions of punishment and corporal punishment yet. Owing to ambiguous definitions, teachers can’t discriminate the difference of them, and may give up the discipline. This study intends to figure out the definitions of punishment and its correlated concepts,and furthermore it would offer teachers some principles to discipline the students. Firstly, we discuss the method of conceptual analysis of analytic philosophy of education. Secondly, we analyze meanings of punishment and correlated words, and comprehend purposes and principles of punishment. The result of the study is generalized that itfs hard to differentiate between punishment and corporal punishment,and punishment should keep principles of reformation and reciprocity. The conclusions of the study are drawn as follow: 1 .Teachers should keep principles of reciprocity and education to punish students. 2.Before punishing students,teacher should follow the principle of proportion. 3.Teachers should show more wisdom to discipline students.
