過往,個人資料均以紙本等實體形式呈現,當人類文化跨入數位時代,隨著人們習於以數 位方式記錄生活,無論是眞實社會的舉措,抑或虛擬網路空間的言行,均逐步轉變爲可供搜尋 與解析的「數位足跡」,印證了「凡走過必留下痕跡」此一民衆耳熟能詳的話語,不僅存在實 體世界,亦於虛擬的數位環境得到印證。在資料探勘等相關技術普及應用下,園繞當事人展開 的數位足跡,衍生創造諸多新穎應用型態,然而儲存方式的變革與雲端應用等新興技術概念的 問世,卻也加深數位足跡遭到不當利用之風險。爲因應資訊時代的巨變,包括隱私權概念與各 國對應保護立法,有不一程度之調整或變革,我國亦不例外。本文以國內於2010年修正通過的 新版個人資料法爲出發點,探討「數位足跡」於新法下之評價,以及在數位浪潮下,個人資料 保護法制發展殊値關注的重要議題,最終提出筆者之看法與建言。

英文摘要

The civilization of human society closely correlates with the record and the transferring mode of information. Personal information used to be recorded in paper or other physical carriers, along with the common utilization of internet and digital technology in the 1990s, people started to handle their personal information with computer and large quantities of personal information were collected by digital devices. Nowadays, under the so-called ubiquitous network society, when we exploring websites, using cell-phone or paying with our credit cards, our daily activities are recorded as "digital footprints" while we interacting in the digital environment. With the increase of digital footprint, the collection, processing and using of digital footprint also raise lots of issues: is digital footprint a protected personal information under domestic privacy legislation? Can we collect or use others' digital footprint without their consent? Whether or not the design of the privacy law can equally apply to the physical world and the digital environment becomes a significant challenge to each countries. Taiwan established the Computer-Processed Personal Information Protection Act in 1995 and the Act was amended in 2010. This article will try to ascertain the legal evaluation of digital footprint under the newest Personal Information Protection Act and discuss how to respond to digital trends. The author will also provide some of personal points of view toward the future development of privacy legislation in Taiwan.
