本文主要在探討「法官全面評核之必要性」與「法官全面評核之項目及方法」。首先，在第「貳」邵分說明司法獨立及司法責任的内涵，並指出法官全面評核的必要性。第「參」部分介紹美國法官全面評核制度的目的、評核機關、評核項目、方法及評核是否公開，之後檢討我國歷來的法官全面評核制度，並提出本文見解。
本文主張，由於我國法官為職業法官，面臨司法正當性的質疑甚鉅，再加上目前社會大眾對司法的高度不信任，故實有承認全面評核之必要性，以強化司法責任。但全面評核僅具有促進法官自我提昇及增進人民對於司法信賴的目的，不具有淘汰法官的功能，且全面評核的内容應僅限於「行為責任」，不包括「決定責任」，強調的是「程序導向」的法官全面評核。

This article discusses the necessity of Judicial Performance Evaluation Program (hereinafter JPE Program) and its criteria in Taiwan. First, it explains the meanings of "judicial independence" and "judicial accountabilityThen, it discusses the necessity of JPE program in Taiwan. Furthermore, it provides the purpose of JPE program and introduces committees which conduct JPE program, then explains some criteria, methodology in the state court level of the United States. Finally, it examines Taiwan's JPE program, and gives some suggestions.
Since Taiwan'sjudges are career judges, thejudicial legitimacy difficulties they face are much higher than elected judges in U.S. Besides, many people in Taiwan nowadays do not trust the judiciary, it's the time to adopt JPE program to reinforce judicial accountability and provide self-improvement for judges to increase public's confidence of judiciary. Most importantly, this program cannot remove judges from their positions, it only focuses on judges' "behavioral accountability" instead of "decisional accountability". It emphasizes a "process-oriented" JPE program.
