依據《教師法》第17條規定,教師負有擔任導師之義務,但研究指出,國民中小學導師工作常是教師的壓力來源之一。隨著《個人資料保護法》的實施,邇來中小學校園中發生一些與學生資料保護議題相關的意外事件,引起社會大眾的關注。影響所及,學生資料保護工作似已成為中小學班級經營必須面對的新挑戰。 有鑑於此,本文擬從《個人資料保護法》的觀點,採用文獻分析與法釋義學方法,進行班級經營的個人資料保護初步探究。首先,探討中小學班級經營之意涵及其新興課題;其次,釐清當前中小學的學生資料保護相關規範,並介紹美國《家庭教育權利與隱私法案》(Family Educational Rights and Privacy Act, FERPA)的重要內涵,以及分析學生個人資料合理使用案例;最後,依研究心得提出未來制定學生資料保護法之建議與配套措施。

英文摘要

According to Article 17 Teacher Act, teachers are under an obligation for tutoring. But researchers pointed that work as a tutor has become one of the pressure of presecondary school teachers. As the enforcement of Personal Information Protection Act, some events related to student information protection have happened in pre-secondary schools recently and caused the public attentions in Taiwan. Accordingly, the protection of student information has seemingly become a new challenge pre-secondary school teachers encountered. Thus, this article aims to discuss the student information protection issues of classroom management by document analysis and law exegesis, from a perspective of Personal Information Protection Act. The basic concept and new issues of pre-secondary school classroom management was firstly discussed. Secondly, the article would try to clarify the regulations related student information protection, and introduce U.S. Family Educational Rights and Privacy Act (FERPA). Finally, suggestions for enactment of Student Personal Information Protection Act and related measures were provided.
