告知後同意(informed consent)的要旨為事先提供當事人充分資訊,在當事人充分瞭解及同意後,才進行相關處置。此一理念來自醫界,因此,本文先行闡述醫界告知後同意的理念,接著說明美國身心障礙者教育法案(IDEA)對告知後同意於特殊教育應用之規範,最後就國內特殊教育法規對告知後同意的規範提出建議。
The main idea of informed consent in special education emphasizes that providing services have to rest on parents’ consent based on being fully informed. Since the idea of informed consent comes from medical field, this article elaborates the concept in medicine first. Then, this article introduces the regulations of IDEA on informed consent, and brings some suggestions for legal regulations and practice in our country.
