藝術品犯罪，是一種財產犯罪、是一種文化犯罪，也是一種跨國境性經濟犯罪。本文先從國際法上對文化資產的重視來論述對藝術作品犯罪之法律觀；並透過犯罪學理論之解釋說明此類犯罪之成因，藉由軍、司法判決書類之分析來探討藝術品犯罪發生的現象及特質。冀在面對藝術品犯罪的多元性、變化性與交易市場複雜性的背後，除提升專門、專業及專責的人、物力資源外，能藉本文達到拋磚引玉之功能，用以喚起對藝術品犯罪的重視。

Art can be described as a statutory crime which the abuse of the law benefits of cultural property, and also a special type of offense. In this paper, a legal point of view, from the international law on the importance of cultural assets to the domestic law of art crimes constraints to describe the legal concept; and through criminological theories to explain the causes of such crime. With military law, the administration of justice report to explore the art of empirical analysis of the phenomenon and characteristics of the crime was committed. In the face of art crime, diversity, variability and complexity of the underlying market, in addition to enhance the specialized, professional and dedicated people and material resources, hoping to get feedback through this paper and to draw the attention of art crime.
