世界各民主國家均允許女子入營服勤，以歐洲多數國家為例，參與軍事訓練及任務派遣，除特定少數任務外，多數軍事單位職務均允許女性擔任。而過去歐洲法院對於性別平等一直扮演相當重要之角色，尤其是在促進、監督及詮釋職業婦女之各項權利部分，使歐盟會員國採取多項之重要改革措施，而讓就業上性別平等之理念更易達成。本文舉德國、法國、義大利、西班牙、英國、荷蘭、比利時及丹麥等國為例說明歐盟各國男、女性軍人工作保障之概況，並以實務見解及德國軍人兩性地位平等施行法之觀點，探討女性軍職人員在職場就業上相關權利之保障，以呼應世界潮流對女權之重視，建立性別平等之法治國社會。
