中文摘要

近年來護理人力嚴重不足,以成為醫療照護產業首要關切議題。其中工作負荷過重、工時過長、未有足夠休息時間與護理人員離職有關。在醫療保健服務業勞動條件檢查違反法令之結果,同時呼應護理人員異動原因。本文之目的是藉由勞動條件相關法規:如勞動基準法,勞動基準法施行細則、性別工作平等法、性別工作平等法施行細則及勞工請假規則之觀點,闡述與醫療照護產業相關之四週變形工時、休假類別與工資界定與給付的規範,以提供護理人員對於勞動條件相關法規之基本認識。

英文摘要

In recent years, a serious nursing shortage has become a critical issue in healthcare industry. Work overload, long working hours, and fewer days-off all contribute to high nursing turnover. In addition, many cases of violation to the Labor Standards Act have been documented in inspection reports. These inspection findings indirectly support the above-mentioned reasons for high nursing turnover. The purposes of this paper are to describe 4-week flexible working hours, types of the leaves and holidays, and the regulations of wages associated with leaves in health care industry according to the relevant laws and regulations in labor standards, such as the Labor Standards Act, Enforcement Rules of the Labor Standards Act, Act of Gender Equality in Employment, Enforcement Rules for Act of Gender Equality in Employment, and Regulations of Leave-Taking of Workers.
