「船員」的工作,傳統上認為是男性的工作領域,我國自1993年起才開 $口放航海科系招收女生,1998年才有女性甲級船員在貨櫃船工作,隨著 船員短缺的問題日益嚴重,吸引更多女性上船工作,將有助於問題的纾解。 「2006 年海事勞工公約」(Maritime Labour Convention, 2006)於 2013 年 8 月 20曰正式生效,是全球海事法規體系重要法規之一,對全球海運業的發展有 深遠的影響。國際上一般認為該公約有助於保護船員的權利,並促進女性船 員的雇用,我國「船員法」及相關法規中,有關女性船員的規定,也應進一步 重新審視。本研究即從國内相關法規及國際公約,探討臺灣女性船員上船工作之規定,並就「船員法」有關女性船員工作規定的修正條文進行討論,並且提出建議。

英文摘要

“Seafarers” have traditionally been the jobs for the male. Navigation departments of universities in Taiwan do not accept female students until 1993 and female officers do not worked on Taiwanese container ships until 1998. Nevertheless, attracting sufficient female to work on ships should help alleviate the increasing shortage of seafarers. Maritime Labour Convention [MLC] (2006) which has become effective since August 20, 2013, is one of the major conventions for international maritime regulatory regime and has a significant impact on global maritime industry. The MLC is expected to protect seafarer rights and promote the employment of female seafarers. Seafarer Act in Taiwan and relevant regulations regarding female seafarer should be re-examined as well. This study addresses current work restrictions on female seafarer from the perspectives of domestic regulations and international conventions. In addition, the recommendations for amending Taiwan5s regulations for female seafarer are provided.
