國防行政乃國家故達成國防目的所實施之必要手段。向為國家行政之核心，而其功能角色*亦 由往昔夸察國、夜警國之涓極千涉（秩序）行政，步入今日福利國家兼負積極給付行政之林，其重 要性尤顯。且由於職能之擴大，為滿足國防目的，辄有侬據相關法律，行使公權力，而無可避免地， 致人民蒙受損失，如徵用人民土地，限制人民行使權利之道法行為，基於「有權利即有软濟」之法 理，不致使人民權利枚濟落空，國家負起損失補偾责任，亦宥無旁贷。 然而，國防法規中有閣損失補償責任之規定為何？其缺失當如何故進？朝囬滿人推保障方向， 作一通盤檢討，當有助於掌握国防行政所生損失補償责任改進及發展應有之方向。

The military administration, through which a nation implements necessary means to achieve its military goals, is the core of administration. Nowadays, as the functional role of the military administration has transferred from “Ordungsverwaltung” to “Leistungsverwaltung”，its impor-tance is much more outstanding than ever. Moreover, with the enlargement of its function and the necessity of national defense, a nation may implement its laws and thus unavoidably deprive the people of their rights, such as the confiscation of land. Under the legal doctrine，“Ubi jus ibi remedium’’，a nation owes a duty to its people to ensure their legal remedies. Therefore, it is valuable to study the provisions of compensation within the military laws and regulations, as well as the defects and the way of improvement therein. Through this research, it is helpful to control the aspects of development under which the duty of compensation coused by the military administration is improved.
