中共繼承法於一九八五年四月十日「第六屆全國人民代表大會第三次會議通遇。」分總則、法定 繼承，遗囑繼承和遺贈、遣產的處理、附則等五章，計三十七條。 中共繼承法的立法原則是保護公民私有財產繼承權依據，遗產繼承男女平等的原則，權利義務相 —致的原則，養老育幼。團结互助，鞏固家庭的原則。 本文收集十二案例，依中共法院調解或判決，加以分析研究以了解大陸地區繼承法實際適用情 形，與民主國家私法自治原則有顯著不同，增加對中共繼承法的了解，在當前兩岸加強交流的時期， 可提供參考。

The Inheritance law of the china was confirmed by the third meeting of the representatives of the people of the sixth term in 1985, It has five articles and thirty seven clauses which includes general principle, inheritance prescribed by law, inheritance by the will of a dead person and legacy, tfie disposition of the legacy and supoplementary rules. the legal principle of the Inheritance law of the China is the basis for protecting the private property inheritance of the citizens, the priniple of the equal rights of both sexes for the legacy inheritanice, the principle of the consistence of the rights and the obligation, the principle of supporting the elder and the children, unifying and cooperation and consolidating the family. This paper collects twelve cases and tries to analyze those cases in accordance with the mediation or the verdict of the court for understanding the applicaition of the Inheritance law in china, the comprison with the self-government prnciple of the private law of the democratic countries and expecting to supply a reference for the scholars and the government.
