國防行政因具組織效能優越特性，向爲國家貫徹國防目的之重要憑藉。居國家行政之核心。尤隨國家任務 發展，其功能角色亦由傳统保國衛民之秩序行政，邁向今日兼負經濟促進爲民服務之给付行政領域。殊值吾人 正視，惟長久以來，仍罕爲各界重視而詳加鑽研，又一般學者對其功能角色，亦多定位爲干涉（秩序）行政， 有加以釐清並研究之必要。 本文論述要點如下： 一、 從行政之由來、意義及戰爭屬於行政之疑義等，描述行政之概念。 二、 分析學者見解並自憲法層次探討，分別説明國防廣狭意義及積極消極目的。 三、 歸纳德日及我國學者對國防行政概念見解，並加以評釋。 四、 由德、日之國防行政在國家任務演進中所扮演之角色，進而探討我國國防行政之角色等，導出國防行 政已由干涉（秩序）行政，邁向给付行政之趨勢。 五、 提出本文對國防行政概念之描述，並依法律形式區分國防行政行爲類型。 六、 就衍生問題，提出改進建議，並做總結。

Based on the functional superiority, the administration of the national defense is a major mean to achieve the goal of the national defense, and it is also the core of the administration of the whole country, with the development of the national responsibility, the function of the administration has changed from the traditional goal of defending the country and the people to the function of economic serving people, However, its function is always being termed as to "Ordnungsverwaltung". Therefore, it is necessary to explore the role and the function of the administration, of the national defense. The points of this paperr are as follow: LTo explore the conception of the administration on the basis of the resource and meanings of the administration and the confusion as to the war which is included in the administration. 2.To decribe the broad and narrow definition and active and Einactive purposes of the administration of the national defense by analyzing the scholar’s views from the aspect of the constutional law. 3. To sum up the scholars views of the Germany, Japan and Republic of China regarding the administration of the national defense and analyze those views. 4. To induce the conclusion that the function of the administration of the national defense has been change from the role of ,fOrdnungsverwaltung,f to "Leistungsverwaltingf, in national responsibility and exploring the role of the administration of the national defense in the Republic of China. 5. To propose the definition of this paper as tQ the administration of the national defense and to categorize the administration of the national defense in accordance with the form of the law. 6. To make suggestions of improvement and conclusions concerving its related problems of the administration of the national defense.
