我國軍事審判法中有關被告自白規定，對維護被告人權及實現法律正義具有重要意義，本文除探 討「自白任意性」及「自白補強性」在軍事審判法上之意義及效力外，並就自白之相關問題由學理及 各國立法例予以比較研究，期能於軍事審判法研修時提供一概略方向，以確保軍人權益，建立公正清 明之軍事審判制度。

In this country, the rules regarding confession in the Military Trial Procedural Act (MTPA) have signigicand importance in safeguarding the human rights of the accused and carrying out the legal justice. In order to provide a possible direction when modifying the MTPA, this article first discusses the meaning and effectiveness of voluntary confession and supplementary nature of confession, and later presents the related issues of confession in a theoretical and comparative stytle; so that the soldiers* fundamental rights could be secured and a just and efficient trial procedural for court-martial could be established.
