現代軍人，面對國際化與數位化戰場，應該擁有相當專業的作戰素養。同時，由於 身處於民主與法治的潮流當中，必須具備一定程度的法律素養，才能正確、有效地執行 任務，並對建軍備戰產生直接、間接的助益；反之，若缺乏應有的法律素養，小則可能 產生破壞軍人形象，抹殺軍人對於國家社會貢獻的後遺，大則可能釀成巨大災變，使國 家、社會或部隊受到嚴重危害。就軍人執行任務可能涉及的層面而言，軍人應該具備的 法律知識包括國内法律與國際公法兩大部分，本文旨在分析我國現代化軍官應該具備何 種法律素養，以及培養充實軍人應具備法律素養的方法，尤其強調，從現代化國軍軍官 的角色與任務加以觀察評析，希提供國軍法治教育參考，並對增進國軍軍官法律素養， 落實建軍備戰與依法行政有所助益。

Facing internationalization and digitalization of the battlefield, modern officers should have expert training. At the same time, since modern oncers operate under the democratic principle of "rule by law," they must cultivate themselves with sufficient legal training so that they can perform their duties accurately and effectively, and can aid in building the military system to prepare for war, both directly and indirectly. Without such legal training, minor negative effects such as damage to people’s impression about soldiers, or glossing over their contribution to the nation and society, could occur. This could also lead to major disasters, severely damaging the military, the nation, and society. Based on the duties they will be executing, officers should cultivate themselves with legal knowledge of both domestic laws and international laws. The purpose of this article is to address the issue of what legal training is needed for modern ROC military officers, and to discuss the means by which such legal training may be implemented. These analyses will be conducted by examining and evaluating the roles and duties of modern officers. It is hoped that such analyses will provide useful material for the military’s legal education; help improve officers’ knowledge of legal matters; enhance military buildup and preparation for war; and aid rule by law.
