廣電事業彼此間在市場上的競爭與合作關係,是否應該一體適用 市場競爭法规(在我國則爲公平交易法),德國法學界曾有過激烈的 爭辯。兩大法域中的法學者除了各自標舉本身的法律思想、批評對方 干擾市場運作(廣電管制)或侵蝕廣電憲章(市場化)之外,也分別 從基本法上關於權力分立、基本權保障等觀點,嘗試提出劃分兩大法 域界限,或甚至調和兩大法域的具體辦法。其中以功能的觀點,試圖 提升基本權保障最適狀態的理論,最値得國内相關法制建構的參考。

英文摘要

After the German ’Lander’ licensed the commercial broadcasters in their territories, the Federal Cartel Agency (Bundesk artellamt) gained consequently its competence over the new broadcasters and tried — which the experts of broadcasting laws strongly criticized — to constrain the established public broadcasters into the same competition model. Since the public broadcasters have obeyed for years rules according to the principle of coordination and integration, it’s no wonder that the expansions of these ’market giants,were steadily warned and eventually forbidden. The experts of the (federal) competition law and those of the broadcasting laws (of the ’Lander’)have developed several theories to resolve the competence disputes problem. Among them the functional approach of the optimal guarantee for 'grundrechte* is especially interesting for readers in Taiwan. The formal approach, on the other hand, is based on the long standing tradition of German legal dogmatics. Therefore it should not be hastily adopted in another country without critical analysis of the cultural differences in between.
