企業擁有專利的目的是要保護自身的市場自由度，也可以做為企業的策略工具，其中最激烈的策略用途，就是利用專利進行攻擊。然而，並非所有專利都可以被拿來當成武器進行攻擊，如果該專利沒有相對的產品於市場流通，或該專利沒有他人使用的可能性，或在專利申請過程有瑕疲，而造成專利權無法實施。所以，在開始布署專利時（不論是自行研發、購入 或授權方式取得），應嘹解哪些因素必須被考量，才可以使用該專利（家族）進行攻擊。專利攻擊方式有許多種類，但本研究定義為「運用法律賦予專利的特殊排他權利，以增加對手研發成本或困難的程度，或透過談判、授權、交互授權、併購、訴訟等手段，致使競爭對手在經濟上蒙受損失」。瞭解如何增強專利攻擊性的因素，在攻擊面上，可引導企業的研發布局，使該企業的專利具有高攻擊性，以獲得經濟上最大利益，並可藉由對專利攻擊性因素的認知，提早得知有哪些攻擊性程度較強的專利已潛伏在企業四周，以減低對企業的傷害。

Patents are not only to protect firm5s freedom of market, but also can serve as a tool for corporate strategy. One of the most intense strategy is patent law suit. However, the patent may be unenforceable if there is no product is included in the patent claims or no possibility of using by others or flaws in the patent application process. Furthermore, how many factors do firm need to care before deploy the patents are very important issue. There are many types of offensive patent which including increase competitor^ R&D cost or R&D degree of difficulty or royalty negotiations or patent law suit. This study explores key factors that affect patent or patent family offensive power and how firms effectively deploy offensive patents to gain competitive advantages and economic benefits. Using patent cases study and regression model, we found that the degree of commercialization, the technical value, and the degree of legal protection for proprietary affect the patent^ offensive power. In sum, this study highlights the significance of offensive patents by identifying three key factors of a patent’s offensive power and exploring how offensive patents are related to firms’ competitive strategy.
