世界各國無不致力於婦女及兒童權益的保護,我國婦幼保護政策的推動,歷 經二十多年來的努力,從中央到地方、從民間到政府,在法制基礎下,形成跨機 構、跨專業的整合服務機制。從過去有關婦幼安全案件的統計顯示,整體婦幼案 件數量並未因為整合服務機制的建構而下降,反而呈現逐步上升的趨勢,而且警 察處理婦幼案件的數量增加,顯示警察在婦幼保護的角色上扮演相當吃重的角色。 警察機關為了執行婦幼保護工作,配合婦幼保護法規之規定,不斷積極調整組織 結構、業務職掌及人力資源等措施,由過去單純執法者角色演變成保護者的角色, 本文以Winter的政策評估理論,針對警察機關推動婦幼保護工作進行全面評估, 透過2場次學者專家之焦點團體座談以及15人次實務工作者之深度訪談,發現 法規對於警察的角色著重於第一時間的通報、提供被害人立即的保護,甚至是外 部網絡成員的安全維護(例如:同行的社工),受訪者(包含外部網絡成員)均表示 這是警察最重要的任務,也是警察認同的角色。然值得注意的是,實務運作上, 除了法規律定之任務外,警察還肩負著犯罪預防宣導、協助被害人申請保護令、 陪同現場訪視、提供諮詢等,如此龐雜之工作内容,即使警察組織歷經改造,但 不論是分局家防官或是派出所社區家防官,始終無法達到專任的目標,不僅家防 官因工作量過大難以久任,人員流動率過高對外部網絡溝通易造成影響,而第一 線面對婦幼案件的派出所同仁無法全面接受訓練,亦影響婦幼案件的工作品質。
警察機關推動婦幼安全政策,偏重在政策執行過程以及結果評估,本文藉由 蒐集警察組織内、外部利害關係人(stakeholders)意見,採取質化方法進行多元 觀點討論,目的在於了解現行政策運作情況與成效,作為警察機關政策改進的回 饋資訊,相關政策修正建議如下:(一)釐清警察機關推動婦幼安全之主要任務; (二)強化警察機關推動婦幼安全之内部組織聯繫;(三)強化警察機關推動婦幼安 全之外部網絡合作;(四)建立警察機關推動婦幼安全績效評量指標。

英文摘要

Countries around the world are dedicated, without reservation, to the protection of woman-and-child rights. Taiwan has undergone more than 20 years in the implementation of woman-and-child protection policy. This policy was created and collaborated between Taiwan’s central and local governments,the public and the NGOs that established a comprehensive service platform with the characteristics of inter-agencies and multiple disciplines. Meanwhile, instead of decreasing the number of cases as expected, the statistics indicates an uprising tendency of woman-and-child victimization in recent years, after giving the concerted efforts by the whole country. Following this line, the increasing number of cases Taiwan police handles not only adds burden to the police but also reflects the indispensable value the police plays in this policy. To enforce the woman-and-child laws more effectively, Taiwan police started restructuring the organization, its command line, and reallocating human resources in order to meet the needs, shifting the role of the police from a law enforcer into a protector in a broader sense. This paper adopts the model of Winter (1990) to evaluate the impact and influence of Taiwan police’s policy on woman-and-child protection.
By virtue of two focus-group discussions and 15 in-depth interviews, this paper finds the laws mandate police to report in real time, to protect battered victim from imminent threat, and to guarantee the safety of social workers who is helping the case. The interviewees in this research all agreed the missions illustrated above are the most important tasks Taiwan police needs to attend to the woman-and-child protection policy. However, on top of these tasks, Taiwan police is also responsible for promoting crime prevention, providing assistance to the victims when applying for protection orders, on-site interviews, and other legal consultation, etc. Although the goal of organizational restructure is to establish a specialized line of duty of “domestic-violence protection officers” in each precinct and “community protection officers,,in each substation, the real situation obviously does not meet the original expectation. Specialized officers are apt to quit or transfer to other offices due to overwhelming workload or the challenges they encountered in working with internal or external counterparts. Beyond that, the lack of sufficient training of the front line officers in substations significantly impacted the quality of case results.
This paper focuses on the process and impact evaluations of the woman-and-child protection policy administered in police authorities. This paper applies qualitative research methods to collect different perspectives from inside and outside stakeholders, in order to evaluate the policy implementation, impact and its outcome results.
Four findings from the evaluation are expected to feedback and review Taiwan police’s woman-and-child protection policy: 1. police needs to streamline and prioritize the primary task in dealing with woman-and-child cases; 2. police needs to strengthen the internal communication protocols across different levels of the organizations; 3. police needs to be more empathetic in collaboration with the counterparts from other government functions and vice versa; 4. police needs to establish a set of clear key performance indicators for administering woman-and-child protection policy.
