2016 年,一場颱風讓4 萬6 千噸的「港泰台州號」貨輪擱淺於金門海灘。 然而這場意外並不僅僅造成財產上的損失,對於環境汙染、生態災難、 兩岸互相協助之障礙及政治立場的不同等問題隨之揭露,另外也顯示出行政 行為的怠惰與雙方不得不面對之事實。當面對的問題是跨區域或屬於多邊協 作的情況時,行政主體的溝通與執行過程的分工及責任歸屬,皆為必須正視 的狀況。本文透由行政法五大架構理論,針對兩岸水域互助協議之可能性, 給予架構性的分析,並嘗試建立協議之模型。本文採用比較法的方式,藉由 先前兩岸在司法互助上所採取之方式作原則性的探討及歸納整理。另以前述 之法學方法建構,希冀能推動未來兩岸水域法制上之進程,並促進兩岸人民 情感及共同利益之最大化。
The 46,000 deadweight cargo ship, Gang Tai Tai Zhou, was stranded at Kinmen beach caused by typhoon in 2016. The accident not only caused loss of property but also revealed some unavoidable problems such as administrative sloth,environmental pollution, ecological disaster, obstacles of cross-strait cooperation and the different political standpoints. With problems of cross-region and multicooperation, the communication between administrative institutions, the executive process and accountability of teamwork are the inevitable issues we should face. This study shall provide a structural analysis against the possibility of salvage agreement across Taiwan Strait. In addition, it shall try to build a model of agreement through the five legal frameworks of administrative law. Moreover, the comparative method is adopted in this study to make discussions and induction. With the aforementioned law methods, the purpose of this study is to promote the progressive law of cross-strait pilot industry, improve the relation between people on cross-strait and maximize the common benefits.
