兩岸制度之差異,乃歷史、文化、地理環境背景使然,鑑於兩岸商業型態之密切與持續發展,以及大量人口湧入城市,租屋法制乃成為城市重要課題,房屋租賃成為市場重要趨勢。為此乃就兩岸房屋租賃法制分析,以各自特有房屋租賃法制,及相近房屋租賃法制作論述比較,並作效益探討。本文經研究認為,由於商業行為之轉型與居住型態變動,兩岸若干房屋租賃法制已不合時宜,相關法制應作調整與修正。

英文摘要

The differences system between Taiwan and China are the consequences of dissimilar historical, cultural and geographical backgrounds. The close ties commercial relationships between cross-strait as well as large number of populations moved into the big city, the legal rental system has become an important subject of the city. This research analyzes the regulations and legal system on both side of the strait, looking at the features unique to either of the systems, and makes a comparison between similar characteristics in the two systems.
In this paper, the study highlight the transformation of business practices and changes in the way of residence, a number of housing leasing on both sides of the legal system were outdated, it can be consider, above all, this article also proposing amendments, adjustments and revise to the relevant legal system.
