法人科技專案研發成果以申請美國專利為優先考量。實務上多受到美國專利法制趨勢影 響。美國實務上自2017年以來均有新發展，包括專利權抗辯理由限制適用權利懈怠，以及耗 盡原則及域外侵權認定等，引導著整體專利法制環境的改變。本文擬以前述影響專利法制整 體發展之重要判決進行探討分析，作為我國授權實務之參酌。
英文摘要
Recent years, The U.S. Supreme Court and the Federal Circuit Court of Appeals have imposed new developments since 2017, as well as the patent exhaustion, laches, and extraterritorial infringement, which have led to changes in the overall patent legal environment. This article intends to discuss and analyze the important cases affecting the overall development of the patent law system from 2017 to July 2018. Provide case studies that can be referenced by technology development program of DOIT.
