本研究發現韓非不只強調以法律判別行爲的對錯,更進一步設定法律的優劣之別。爲判斷法律之良窳,韓非從政治社會的起源、人類行爲的傾向,以及法律本身的性質等三個面向設定判斷標準。並且從這三項標準可以尋繹出立法者也必須具備察識時變、因用人情、明辨公私等三項能力。在中材之主不具備立法能力的現實中,韓非的設想是以中材之主任用法術之士以因時而制宜的創制法律。
This research finds that Hanfei not only emphasized right behavior that is determined by law, but that he also set up the standards for determining better law. In order to judge better law, Hanfei set up three standards of criteria: the origin of the political society, the disposition of human behavior, and the property of the law. Based on these three standards, lawmakers are required to have three kinds of abilities, which are: to give insight into environmental change, to make use of the disposition of human behavior, and to correctly distinguish between public and private. However, mediocre governors don’t have the abilities for making better law. To solve this problem, Hanfei’s legalist design assists mediocre governors in making better laws for a well-ordered political society.
