2019年12月12日馬來西亞引據《聯合國海洋法公約》第76條規定,單獨向「聯合國大陸礁層界限委員會」(CLCS)遞交該國在南海200海浬外大陸礁層延伸案。隨著「中」美關係走向結構裂變,川普政府升級「中」美南海衝突,明確表達南海立場,實際敦促了南海各聲索國進一步強化2016年「菲中南海仲裁案」仲裁判斷法制化的動因。本文旨在探究中國大陸對馬來西亞聲索南海大陸礁層案及其延伸之各方外交照會的回應立場,此將關乎CLCS是否將承認南海仲裁案的法律效力,進而重啟2009年越馬聯合提案以及2009年越南單獨提案之審議進程。同時,聯繫2019年馬來西亞單獨提案的非聲索國(印尼、美國、澳洲)聲明立場,進一步否定南海歷史性水域法律地位和直線基線劃設,彼等後續法律主張及效應值得關切。
This paper aims to explore the legal implication concerning 2019 Malaysia's partial submission to the Commission on the Limits of the Continental Shelf (CLCS)regarding the extended continental shelf beyond 200 nautical miles (NM) in the South China Sea (SCS). As US-China relations move toward structural competition, the Trump administration has escalated potential conflicts between China and the United States and clearly expressed its position in the South China Sea, which actually urged the claimant countries in the South China Sea to further strengthen the practice of the legalization in the 2016 “South China Sea Arbitration”. This article also reviews the Chinese mainland's response to the Note Verbale of the parties involved in the case of Malaysia's 2019 submission, which will be related to whether CLCS will recognize the legal effect of the South China Sea Arbitration and then resume the 2009 Vietnam-Malaysia joint submission and the review process of the 2009 Vietnam's independence submission. At the same time, the non-claimants (Indonesia, the United States, Australia) proposed their positions and further denied the legal status of the historic rights in the South China Sea. Their subsequent legal claims and effects are worthy of concern.
