「有土斯有財」對台灣人民來說是根深蒂固的傳統觀念,而住屋是人民最基本必要的需求,由於不動產買賣所涉及的金額比其他任何消費高,所涉及的法令規定複雜繁瑣,一般消費者大多數欠缺不動產買賣契約相關專業知識及法律知識,導致不動產買賣糾紛問題越來越多,甚至於在不動產買賣上也出現了詐騙行為。本文透由仲介本身、買賣雙方及仲介自我調適等三個角度探討不動產買賣糾紛及因應之道;經由實證訪談研究發現,房仲業者需要有專業知識、服務熱忱、熟知未來房地產走勢,且清楚各項優惠貸款條件資訊、法令規範及謹守交易誠信原則,同時顧及買賣雙方重視交易過程的安全性信賴,在確保房仲有合理利潤之虞,亦可達不動產買賣糾紛之預防。

英文摘要

"There is land and wealth" is a traditional concept deeply rooted in the people of Taiwan. Housing is the most basic need of the people. Because the amount of real estate purchases is higher than any other consumption, and the legal regulations involved are very complicated. Most consumers lack professional knowledge and legal knowledge related to real estate sales contracts, resulting in more and more disputes over real estate sales and even fraud. This article explores the causes and corresponding methods of real estate transaction disputes from three perspectives: the agency itself, the buyers and sellers, and the agency's self-adaptation. Through empirical research, it is found that real estate professionals need to have professional knowledge, enthusiasm for service, familiarity with future real estate trends, and clear information on various preferential loan conditions, laws and regulations, and adhere to the principle of transaction integrity. In addition, in order to take into consideration, the safety of the transaction process by both buyers and sellers, and to ensure that the housing agent has a reasonable profit, it can also achieve the purpose of preventing real estate transaction disputes.
