研究指出,親子關係互動之良窳與少年犯罪有密切相關,在傳統修復式司法研究中,透過修復式司法使少年認知錯誤,承擔責任,促進少年同理心的學習,減少再犯等相關報告或論文並不足為奇,惟對於修復式司法與親子關係影響之實證研究並不多見,而本文即在探討少年之親子關係是否受修復式司法之影響。本文以國內少年事件中實施修復式司法之少年及其家長為研究對象,進行問卷及訪談,透過相關文獻之爬梳,就親子關係部分進行分析。研究結果顯示,少年事件中父母教養風格對於親子關係有重大影響,雖部分少年因童年逆境經驗與家庭結構問題難從修復程序中改變親子關係,然多數少年與家長因修復程序所提供正向的溝通循環,親子關係於修復後明顯產生正向改變。研究也發現,部分少年與家長在修復程序後,面對實際的生活仍可能備感壓力與挑戰,甚至因現實的生活反映出親子關係無力改善的處境。本文不但顯示修復式司法可以具體實踐,並充分運用於少年事件中作為基本處遇,同時提醒修復工作者,修復式司法運用在少年事件可以且應該照顧到建設性親子關係的發展;然而,我們也必須承認其絕非萬靈丹,針對少年非行的防治對策,終究應回歸穩定的社會支持網絡及有效的健全社會聯繫。

英文摘要

Research points out that the goodness of parent-child interaction is closely related to juvenile delinquency. Conventional Restorative Justice (RJ) studies frequently indicated the delinquent juveniles may recognize mistakes, assume responsibility, promote empathy learning, and reduce recidivism using the RJ program. Nevertheless, empirical research on the influence of RJ and the parent-child relationship is rare. This study aims to explore whether the parent-child relationship of delinquent juveniles is affected by RJ. The research samples are teenagers and parents who participated in RJ's conflict mediation model in domestically juvenile delinquency cases. Conduct questionnaires, interviews, and combing relevant literature to analyze the parent -child relationship. Our study report that parent's rearing style has a significant impact on the parent-child relationship in juvenile delinquency cases. Although for some juveniles, it is hard to change the parent-child relationship through the RJ process due to childhood adversity experiences and the family's structured problems. However, the RJ process provides a positive communication circle to these teenagers and their parents, clear most of them the parent-child relationship has a positive change after the RJ process. The study has also found some teenagers and their parents may still feel pressure and challenges in their real lives after the RJ process, even reflecting the inability to improve the parent-child relationship. This study suggests RJ not only can be practically practiced but also be fully used as a base treatment in juvenile delinquency. Simultaneously reminds facilitators that using RJ approaches in juveniles delinquency can and should consider the developments of constructive parent-child relationships. However, we have to admit that it is by no means a panacea. The prevention and treatment measures aimed at delinquent juveniles should eventually return to a stable social supporting network and an effective social bond.
