「陽儒陰法」是用來描述自漢武帝開始至清末,帝制中國歷代的統治者的管理思維。此名詞是一個包括哲學的、政治的與管理績效三層面的多義詞。它代表一個集權式、君尊臣卑式帝國治理的指導意識型態以及治國之策略。而此策略的思考的哲學理論依據,取荀子的「隆禮崇法」,以及其弟子韓非的「法、術、勢」融鑄而成一套「大一統」的哲學思維與官僚體制管理之術。本文立基於統整荀、韓二子在「禮」與「法」的複合結構中展開「陽儒陰法」基礎理論之建構,包括管理思維之形成與管理架構的組合,表現在理念層次上具有「隆禮崇法」的治國策略之意義,在客觀層面上則包括策略性、權變性、競合關係與制度性並存之實踐,以求其治理績效。
Yang-Confucianism-Yin-Legalism is used to describe the management thinking of rulers of successive dynasty in Imperial China starting from Han Wu Di to the End of Qing. This terminology is a polysemy in three spheres including philosophical, political, and management performance. It represents a guiding ideology of imperial governance that with centralization and emperor superior to ministers, and strategic management of governing nation. The philosophically theoretical basis of this strategic thinking, adopting Xunzi’s Advocating Etiquette and Dignifying Law, and his disciple, Han-Fe’s Law, Technique, Power, is melt-casted to be a set of management technique of philosophical thinking and bureaucratic system of Grand Unification. This article is based on integrating Xunzi and Han Fe’s complex structure of etiquette and law to explore construction of fundamental theory in Yang-Confucianism-Yin-Legalism, containing with formulation of management thinking and combination of management structure, presenting in subjective dimension the meaning of governing strategy with Advocating Etiquette and Dignifying Law and in objective dimension the practice of strategic, contingent, cooptative, and institutional coexistence to pursue governing performance.
