外籍移工在台灣工作已經行之多年,每年皆有許多勞雇糾紛,依據勞動部1955專線申訴受理外籍移工的勞資爭議案件統計,案件逐年增加。移工會先到各地方勞工局進行申訴,並被安排進行爭議協調。在協調處理過程中,統計發現移工存在幾點問題,造成協調失敗,包括看不懂中文,語言溝通障礙,不相信通譯員,認為有偏袒思維,文化生活差異,且勞雇雙方對法令認知有落差。因為勞工局必須依法行政,依據勞動部網頁系統,進行外國移工申訴協調時,系統全部使用中文制式化表格,且移工無法表達個自申訴類別之主張,並雙方無法確認真正申訴爭議標的,導致部分協調案件,移工無安全感、無信賴感、拒絕簽名,因此,協調失敗。且現有系統,協調員了解案件並溝通及釐清爭議處理過程中浪費太多時間翻譯,如何能協助移工解決爭議標的,解決語言障礙及縮短協調員繕打協調紀錄時間,成為重要課題。本研究以新北市外籍移工越南籍爭議協調為例,依據該局從事越南移工勞資爭議協調人員之經驗,研究開發一套期能提升協調效率,快速聚焦勞、雇、仲介三方爭議標的,並協調人員能公平、明確回應爭議標的之「即時爭議協調系統」。本研究開發之系統,為一雙語即時網頁,首先將所有勞雇爭議制式化,以選擇題或填空題在網頁上呈現;配合協調會議進行,爭議結果使用投影機顯示於協調會場,並該網頁可以由勞、雇、仲介三方手機同時觀看。處理過程之結果,同步顯示於投影幕以及所有勞、雇、仲介三方手機。因此,達到爭議制式化,同步進行協調、快速聚焦爭議問題。而且因為即時網頁,使用雙語同步進行協調結果,讓勞、雇、仲介三明瞭爭議類別,順利回應三方之主張,並協調員無有偏袒一方達到公平公正之協調。

英文摘要

Foreign migrant workers have been working in Taiwan for many years, and there are many disputes between labor and employment every year. According to the statistics of labor disputes involving foreign migrant workers on the special line 1955 of the Ministry of Labor, the number of cases has increased year by year. The migrant first went to each local labor bureau to appeal and was arranged to coordinate the disputes. During the process of coordination, statistics found that there were several problems with migrant workers, which caused coordination failure, including inability to understand Chinese, language communication barriers, distrust of interpreters, biased thinking, differences in cultural life, and recognition of laws and regulations by both employers and employees. There is a gap. Because the Labor Bureau must administer according to the law, according to the Ministry of Labor’s webpage system, when coordinating foreign migrant workers’ appeals, the system uses all Chinese standardized forms, and the migrant workers cannot express their claims in a self-appeal category, and the two parties cannot confirm the true subject of the appeal. As a result, in some coordination cases, migrant workers feel insecure, unreliable, and refuse to sign. Therefore, coordination fails. In addition to the existing system, the coordinator understands the case and communicates and clarifies that too much time is wasted during the dispute resolution process. How to assist migrant workers in resolving the subject of the dispute, solving language barriers and shortening the time for the coordinator to coordinate and record have become important issues. This study takes the coordination of Vietnamese migrant workers in New Taipei City as an example. Based on the experience of the bureau’s labor dispute coordinators for Vietnamese migrant workers, the research and development to improve coordination efficiency and quickly focus on the subject of labor, employment, and intermediary disputes are expected. And the coordinator can respond fairly and clearly to the "real-time dispute coordination system" that is the subject of the dispute. The system developed by this research is a bilingual real-time web page. First, all labor and employment disputes are standardized and presented on the web page as multiple-choice questions or fill-in-the-blank questions; in conjunction with the coordination meeting, the dispute results are displayed in the coordination venue using a projector and the web page, it can be watched at the same time by three parties, labor, employment, and intermediary. The result of the processing process is simultaneously displayed on the projection screen and all mobile phones of labor, employment, and intermediary. Therefore, it is possible to standardize disputes, coordinate and quickly focus on disputes. And because the real-time webpage uses bilingual synchronization to coordinate the results, labor, employment, and intermediary can understand the types of disputes, and smoothly respond to the three parties' claims, and the coordinator can achieve a fair and just coordination without favoring one side.
