虛擬資產於金融科技發展中扮演重要角色，然而，虛擬資產亦為金融監管機關帶來投資者保護、金融穩定、公平競爭、市場完整性以及安全風險等艱鉅的監管挑戰。為確保可為投資者提供更優質之金融商品，金融監管機關須要直接面對挑戰解決上述困境。本文擬以歐盟與美國為中心出發，研析虛擬資產政策，探究金融監管機關該如何建立健全法律框架，並於最後試為我國提出虛擬資產監管建議，以期維護投資者權益，促進我國金融科技創新發展。

Virtual asset plays vital role in the development of FinTech. However, virtual asset poses extremely challenges for financial regulators, such as consumer protection, financial stability, fair competition, market integrity, and security risks. To enable better financial products for consumers, these challenges must be addressed. This thesis researches on virtual asset policies of major countries, including the EU and U.S., to explore how financial regulators are supposed to implement a sound legal framework. Finally, this thesis will propose suggestions to protect consumers and promote financial innovation.
