網路是現今社會的人們賴以發展人際關係及尋求情感連結的重要媒介。但隱藏在網路媒介平台下的危機是多數人可能成為數位性暴力下的受害者卻不自知，科技及數位時代的迅速發展使得性別暴力的樣態不再侷限過去刻板印象中的言語或身體傷害。更嚴重的是，姓名或社群媒體帳號等個資竟能在影像中被揭露，這無異加深對被害人的傷害並影響其日常生活。近年來因網路發達而使得性私密影像被傳播的速度越來越快且容易取得，網絡平台因而成為犯罪的溫床。《刑法》做為最後一道防線，本應扮演嚴懲散布性私密影像的犯罪行為人及保護被害人。惟在現行《刑法》有法律漏洞的情況下，實有以其他法律補上此缺口之必要性。因此，本文的研究問題聚焦在當復仇式色情無法以刑法論處時，《性侵害犯罪防治法》是否能及時填補，以保障當性私密影像遭他人做為犯罪工具而侵害個人法益之我國人民，並提出《性侵害犯罪防治法》可再精進之處，做為本文研究發現。

The Internet is an important medium for people to develop interpersonal relationships and seek emotional connections in today's society. But the crisis hidden under online media platforms is that most people can become victims of digital violence without knowing it. The rapid development of technology and the digital age has made gender-based violence no longer limited to the stereotypical verbal or physical harm of the past. More seriously, personal information such as names or social media accounts can be revealed in images, which is tantamount to deepening the harm to victims and affecting their daily life. In recent years, due to the development of the Internet, sexual intimate images have been spread faster and more quickly and easily, and online platforms have become hotbeds for crime. As the last line of defense, the Criminal Law is supposed to severely punish perpetrators of sexually intimate images and protect victims. However, where there is a legal loophole in the current Criminal Code, it is necessary to fill this gap with other laws. Therefore, the research questions in this article focus on whether the Sexual Assault Crime Prevention Law can be filled in time when revenge pornography cannot be dealt with by criminal law, so as to protect the people in Taiwan who intimate sexual images are used by others as a criminal tool to infringe on their personal legal interests, and put forward the further refinement of the Sexual Assault Crime Prevention Law as the research findings of this article.
